Terms & Conditions

A. Arrival:

All participants must arrive 15 minutes before the paddle activity session start time. For sailing sessions, please arrive 30 minutes before in order to set up the boat.

B. Health:

All participants must be physically fit and able, except in circumstances notified to and accepted by the Trust. They must, at the time of booking, advise of any illness or disability (such as diabetes, epilepsy, asthma, heart condition, recent injuries, hearing impairment, visual impairment etc) that may affect their ability to participate. If at all unsure, participants must check with a doctor before booking and must be able to produce a note from their doctor if required. Details to be noted on booking form.

Participants must bring any necessary medication with them and ensure that staff are made aware of what medicine this is and how it is to be administered. The Trust reserves the right to refuse any booking on medical grounds if the medical condition is considered to be detrimental to the safety and smooth running of the course.

C. Safety:

All participants must comply with the safety regulations and instructions of centre staff. Watersports and adventure activities are hazardous by their nature. Participants, parents or guardians must accept that there are risks: inevitably bumps and scrapes will happen during the thrills and spills of fast-moving activities.

To manage these risks, so far as we are able, we:-
contract instructors trained within national governing body guidelines and teach to national governing body recommendations

● have robust management and safety systems which have been inspected by approved bodies such as AALA, RYA and British Canoeing.

● reserve the right to modify or cancel an activity if we feel that there are unmanageable risks.

D. Consent Forms:

A consent form must be completed for every individual.  If a minor this must be completed and signed by the parent/guardian.

E. Age limits:

Accompanied children of all ages can take part in our River Medway activities. The minimum age is 8 for instructor-led sessions in canoeing/kayaking, raft building, sailing, stand up paddle-boarding, Kid’s Clubs and land-based activities. The minimum age for Family Taster Sessions is 3. The minimum age is 12 for power boating courses.

F. Food:

Participants will be responsible for provision of packed lunch for full day activities or courses unless advised to the contrary at time of booking.

G. Payment:

All session activities must be paid for in full at the time of booking via our website booking system, unless alternative terms agreed more than 28 days prior to booking for Group/School bookings.

Clients must notify Medway Watersports Trust of cancellations as soon as possible via email or phone. No cooling off period applicable to leisure activities provided by Medway Watersports Trust. All activity session tickets are non-refundable and non-transferrable.

Group/Course bookings: The responsibility for obtaining relevant insurance to cover the cost of cancellation rests with the client.
Clients who cancel 28 days or more before the start of their course/group booking will have 50% of the course/group fee returned to them. Clients who cancel fewer than 28 days before the start of their course/group booking will forfeit the full fee.

Course bookings may be transferred 28 days or more prior to the commencement of their original course. No transfers may be made fewer than 28 days prior to the commencement of the Course. Transfers are subject to course availability and a £15 administration fee will be levied for each transfer. Only one transfer of dates may be made per booking; no refund will be given for any subsequent cancellation.

Non-attendance without prior agreement will result in the entire fee being forfeited.

H. Cancellations by Medway Watersports Trust:

Every attempt will be made to ensure all courses/sessions run. However, Medway WatersportsTrust reserve the right to cancel a course/session if viable participant numbers are not achieved, or in the case of inclement weather. Instructor-led sessions may be cancelled by Medway Watersports Trust at short notice if it is deemed unsafe to run the session.

In order to avoid cancellation of a paddlesports, kayaking or canoeing session it may be necessary to move the session to an inland water venue and Medway Watersports will advise the participants as soon as practicably possible before the session is due.  If this is not suitable for the participant Medway Watersportswill offer a full refund.

When an activity /course has to be cancelled, we will make a full refund.

Medway Watersports Trust will not accept any liability for any other expenditure or costs incurred by prospective participants. The responsibility for obtaining relevant insurance to cover the cost of cancellation rests with the client.

I. Equipment:

All necessary safety equipment is provided as part of your activity/course fee, apart from footwear

J. Unruly Behaviour:

Participants and members of their party are required to have consideration for others at the Centre. If, in the reasonable opinion of centre staff, a person acts in such a way as to cause, or be likely to cause, danger, upset or distress to any other customer or member of staff, they shall be asked to leave the Centre immediately. The Centre will not pay any refunds, expenses or costs as a result.

K. Disputes:

Any complaint should, in the first instance, be addressed with the member of staff concerned. If they are unable to resolve the issue, they should refer the matter to the Centre Principal. If the Centre Principal is unable to resolve the issue to the client’s satisfaction, complaints should be sent in writing to: Les Snowdon, Trustee, Medway Watersports Trust, Strand Approach Road, Gillingham, Kent ME7 1TT, or email sails@medwaywatersports.co.uk.

L. Photographs:

Participants agree to photos and video being taken of them engaging in activities. Participants grant Medway Watersports Trust full and free rights to use these photos and videos.

M. Privacy Policy:

Please see our Privacy Policy which can be found on our website.
We reserve the right to alter these conditions at any time during the year.

These terms and conditions will apply to additional sessions for which a new form will not be required. However, any new health condition must be advised in writing before taking part in further activities.
